Class C  Education Code 25.093

Filed against the parent. Each day the child is out may constitute a separate offense. Half of the fine collected goes to the operating fund of the school district attended. The other half of the fine collected goes to the general fund of the court where the complaint is filed. The fine is up to $500 per violation.

*The offense sounds as if it has a lot of punch; but speaking honestly, it is as effective as the judge who decides the fine, the community service hours in lieu of the fine, or the special school the child could be made to attend so as to force compulsory school attendance. Another problem is that it has become easier to find doctors who will write notes to excuse absences.

A child commits this offense. Refer to Education Code 25.086 Exemptions.  There are 9 exemptions. You will need to verify actual enrollment in a high school equivalency program, private or parochial school attendance, or a physician’s note regarding a temporary and remedial physical or mental condition.

Refer to Education Code 25.095 Warning Notice. A school district shall notify a student’s parent in writing of absences, yet under ( c) it is not a defense to prosecution if the parent did not receive a notice.
